Any verbal or written recommendation regarding property value, investment potential, or market timing is an opinion based on available data and does not constitute a guarantee of future performance.

2. Market Intelligence Reports

Market intelligence reports are compiled from public records, proprietary databases, and third-party sources believed to be reliable. However, PenfoldRealty makes no representation as to the accuracy or completeness of such data. Reports are prepared for the exclusive use of the named client and may not be distributed, reproduced, or used for competitive purposes without prior written consent. All figures are indicative and subject to revision.

3. Client Relationship & Confidentiality

Engagement as a client of PenfoldRealty implies acceptance of our standard terms of business, including confidentiality obligations. We undertake to protect all non-public information shared during the course of our relationship. However, we are not liable for disclosures required by law, regulatory bodies, or court order. 4. Property Listings & Representations

All property listings presented by PenfoldRealty are subject to prior sale, withdrawal, or price change without notice. Floor plans, dimensions, and photographs are provided for general guidance only and may not be to scale. Any statements regarding zoning, rental potential, or development rights should be independently verified with the relevant municipal authority. PenfoldRealty acts as an intermediary and does not warrant the condition or title of any property.

5. Limitation of Liability

To the fullest extent permitted by South African law, PenfoldRealty’s aggregate liability arising from or related to any engagement shall not exceed the total fees paid by the client for the specific service giving rise to the claim. In no event shall PenfoldRealty be liable for consequential, indirect, or incidental damages, including loss of profit or opportunity, even if advised of the possibility of such damages.

6. Governing Law & Disputes

These terms and any disputes arising from them shall be governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved through good-faith negotiation shall be referred to mediation in Cape Town before any court proceedings are initiated. The parties agree to submit to the exclusive jurisdiction of the High Court of South Africa, Western Cape Division.
